Birthright Citizenship Back Before Supreme Court As Trump Calls It Outdated

President Donald Trump weighed in Tuesday on the upcoming Supreme Court case on birthright citizenship, arguing that the 14th Amendment was never intended to apply to the children of undocumented immigrants or foreign nationals visiting the U.S.

In a lengthy Truth Social post, Trump claimed the post-Civil War amendment was specifically designed to guarantee citizenship for the children of formerly enslaved people, not those seeking to “scam” the system through birth tourism or illegal entry. He pointed to the historical context of the amendment’s passage in 1866, saying mass immigration was not a relevant issue at the time.

Trump first sought to end birthright citizenship via executive order during his first term and has pledged to revisit the issue. The Supreme Court is expected to consider whether the current interpretation of the amendment remains valid in today’s landscape.
